OTITA Terms of Use

These Terms of Use (the "Terms") set out the conditions for using the smartphone app "OTITA" (the "App") provided by Seee ("we"). By using the App, you agree to these Terms. If this English version differs from the Japanese version, the Japanese version prevails.

1. About the App

The App measures the time you spend away from your smartphone and suggests movies you could have watched in that time. Movie information (titles, release years, directors, runtimes, synopses, poster images, and so on) is based on public sources such as Wikidata, Wikipedia, and Wikimedia Commons, and we do not guarantee its accuracy.

2. Premium (monthly subscription)

1. With Premium, you can open suggested movies on the streaming service you choose, save movies to a Watch later list, and see statistics of your time away.
2. The price shown on the purchase screen (including tax) is charged to your Apple Account.
3. The subscription renews automatically unless canceled at least 24 hours before the end of the current period.
4. You can cancel in your App Store subscription settings. Deleting the App does not cancel the subscription.
5. Refunds are subject to Apple's policies.
6. Watching a movie on a streaming service requires a separate subscription to that service. We do not guarantee that a movie is available on any streaming service.

3. Prohibited conduct

You must not:

• Violate laws or public order and morals
• Interfere with the operation of the App
• Disassemble, modify, copy, or redistribute the App
• Do anything else we reasonably consider inappropriate

4. External services

Your use of external services reached from the App (streaming services, Wikipedia, and so on) is governed by their own terms. We are not responsible for the content of external services or for any damage arising from their use.

5. Copyright and licenses

• Copyright in the App's program, design, pixel art, and so on belongs to us.
• Some synopses are excerpts from Wikipedia articles and are available under the Creative Commons Attribution-ShareAlike 4.0 License (CC BY-SA 4.0). The source is shown with each movie.
• Poster images are images published on Wikimedia Commons.

6. Disclaimer

1. We do not guarantee that the App is free of defects or fit for any particular purpose.
2. Except in cases of our willful misconduct or gross negligence, we are not liable for any damage you suffer from using the App.
3. We may change or discontinue the App without prior notice.

7. Changes to these Terms

We may change these Terms when necessary. The revised Terms take effect when posted in the App or on our website.

8. Governing law and jurisdiction

These Terms are governed by the laws of Japan. The district court having jurisdiction over our address shall have exclusive jurisdiction as the court of first instance for any dispute relating to the App.
